Please read these Terms & Conditions ("Terms") carefully before using QuoteCraft Estimates ("QuoteCraft," "the App," "we," "us," or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
These Terms constitute a legally binding agreement between you and QuoteCraft. If you do not agree to these Terms, do not use the App. We may modify these Terms at any time, and your continued use of the App after changes are posted constitutes acceptance.
2. Description of Service
QuoteCraft provides tools to create professional estimates and invoices, manage customers, track payments, and generate PDF documents. Features may vary by platform, app version, or subscription plan.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) to use QuoteCraft for business purposes. By using the App, you represent that you meet this requirement and have the authority to enter into these Terms.
4. Your Account and Responsibilities
You are responsible for:
- All activity that occurs through your use of the App on your device
- The accuracy of business data you enter, including customer details, prices, taxes, and payment records
- Backing up your data and maintaining the security of your device
- Complying with applicable tax, invoicing, and business laws in your jurisdiction
5. Acceptable Use
You agree not to:
- Use the App for any unlawful, fraudulent, or misleading purpose
- Reverse engineer, decompile, or attempt to extract the App's source code
- Interfere with or disrupt the App's operation or security
- Use the App to send spam or unsolicited communications
- Misrepresent your identity or affiliation when using the App
6. Intellectual Property
QuoteCraft, including its design, logos, software, PDF templates, and content, is owned by us or our licensors and protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable license to use the App for your personal or business purposes in accordance with these Terms.
You retain ownership of the business data and content you create. You grant us a limited license to process that data solely to provide and improve the App.
7. PDF Templates and Documents
PDF designs and templates provided in the App are for your use in generating client-facing documents. You are responsible for reviewing all estimates and invoices before sending them to clients. QuoteCraft does not guarantee that generated documents meet specific legal or regulatory requirements in your region.
8. Free and Paid Features
QuoteCraft may offer free and paid features. Pricing, billing, and subscription terms (if applicable) will be presented within the App or on the applicable app store. App store purchases are subject to the terms of Apple App Store or Google Play, as applicable.
9. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED.
QuoteCraft is a tool to assist with invoicing and estimates. We are not an accounting, tax, or legal advisor. You should consult qualified professionals for tax, accounting, or legal advice.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, QUOTECRAFT AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP.
OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR USD $50, WHICHEVER IS GREATER.
11. Indemnification
You agree to indemnify and hold harmless QuoteCraft from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the App, your business data, or your violation of these Terms.
12. Termination
We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination will remain in effect.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which QuoteCraft operates, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction, unless otherwise required by applicable consumer protection laws.
